Introduction
These Terms of Service govern your access to and use of the U1st Eats platform. By accessing or using our platform as a Customer, Merchant or Dispatch Rider, you agree to be bound by these Terms.
The U1st Eats Platform
U1st Eats is a technology platform that connects Customers looking for food and everyday items with independent local Merchants and independent Dispatch Riders. U1st Eats does not prepare food, nor do we employ the Dispatch Riders. We provide the technology to facilitate the transaction and track the logistics.
User Roles and Responsibilities
1. Customers
- You agree to provide accurate delivery addresses and contact numbers.
- You must be present, or have someone present, to receive the order at the designated location.
- You agree to pay all costs associated with your order, including food costs, delivery fees and platform service fees.
2. Merchants: Restaurants and Stores
- You are solely responsible for the quality, safety and packaging of the food and items sold through the platform.
- You must maintain accurate menus, pricing and operating hours on your U1st Eats dashboard.
- You agree to prepare orders promptly to support efficient pickup by Dispatch Riders.
3. Dispatch Riders
- You are independent contractors, not employees of U1st Eats.
- You must possess a valid driver’s licence, necessary permits and maintain your vehicle in a safe, working condition.
- You agree to transport orders safely, directly and professionally to the Customer.
Payments and Refunds
All payments made through the platform are final. Refunds are handled on a case-by-case basis. If a Merchant fails to fulfil an order, or a Rider fails to deliver it, U1st Eats will investigate and may issue a refund or platform credit at our discretion.
Limitation of Liability
U1st Eats is not liable for any illness, injury or damages arising from food prepared by Merchants or accidents caused by Dispatch Riders. We provide the platform “as is” and make no guarantees regarding the continuous, uninterrupted operation of the app or website.
Account Termination
We reserve the right to suspend or terminate the account of any Customer, Merchant or Rider who violates these Terms, engages in fraudulent activity or creates an unsafe environment for other users.
